This Policy applies to all users (hereinafter referred to as "User", "You", or "Your") accessing our digital platform, mobile applications, and offline personalized deal concierge services (collectively, the "Platform").

By accessing, registering, or transacting on the Platform, You expressly consent to the data practices described in this Policy. This Policy shall be read in conjunction with the Sthavr Terms of Service (ToS), which exclusively governs commercial warranties, user conduct, and transaction liabilities.

  1. Statutory Framework & Compliance

The Company acts as a "Data Fiduciary" under the applicable laws of India. We employ commercially reasonable measures to align our operations with overarching statutory frameworks, including data protection, technology, and real estate regulations (such as the DPDP Act, 2023, the Information Technology Act, 2000, and RERA, 2016). Our compliance protocols are designed to address mandatory statutory reporting, record-keeping, and data protection standards dynamically as our operational footprint scales.

  1. Scope Of Stakeholders

The Platform serves as a structured digital ecosystem facilitating premium real estate transactions of all sizes, from independent plots to large-scale housing societies. This Policy applies to:

  • Buyers/Transferees: Investors, developers, family offices, and verified individuals.

  • Sellers/Transferors: Corporate entities, private landowners, and housing societies.

  • Realtors & Mandate Holders: Real estate brokers, agencies, and consultants who onboard property mandates onto the Platform.

  • Empanelled & Referred Professionals: Internal and external legal consultants, valuers, architects, financial advisors or other service providers operating through or referred by the Platform.

  1. Categories Of Data Collected

In adherence to the principle of data minimization, We collect only such information as is necessary for the execution of Our services and the marketing of real estate assets.

4.1. Personal and Corporate Identity Data

  • Full name, registered address, email address, and contact numbers.

  • Corporate governance documents (Certificates of Incorporation, Board Resolutions, Director Identification Data).

  • Statutory identification for Know Your Customer (KYC) and intent verification (e.g.Aadhar Card, PAN, Passport, Voter ID).

4.2. Property, Title & Development Data

  • Core Title & Authorizations: We collect essential documents required to ascertain preliminary ownership and legal authorization to transact, such as primary Title Deeds, No Objection Certificates (NOCs), and explicit authorization letters/mandates.

  • Development Potential & Analytics: To effectively market properties to potential buyers, We collect and process comprehensive property-related data. This includes but is not limited to zoning remarks, Floor Space Index (FSI) calculations, topographical data, market potential analytics, and feasibility reports.

  • Limitation on Exhaustive Records: Unless strictly required to resolve a dispute regarding ownership or legality, the Company does not inherently store exhaustive historical title search reports or ancillary personal property documents on the Platform.

  • Transaction Metrics: Standardized Letters of Intent (LOIs), commercial bids, earnest money deposit (EMD) values, and transaction timelines.

4.3. Financial Data

  • Bank account details required for nodal escrow routing, EMD processing, and platform success fees. (Note: We do not process or store credit card numbers or primary banking passwords).

4.4. Technical Data

  • IP addresses, browser types, device identifiers, and chronological audit logs of document access and digital signatures on the Platform.

  1. Purpose Of Processing

Your data is processed exclusively for the following authorized, lawful purposes:

  • Transaction Execution: Facilitating the negotiation, structuring, and execution of real estate transactions.

  • Asset Marketing & Blind Discovery: Presenting property metrics, development potential, and feasibility data to verified counterparties whilst withholding identifiable ownership or exact location data until a Non-Disclosure Agreement (NDA) is executed.

  • Verification & Due Diligence: Conducting preliminary KYC to eliminate speculative actors and ensuring Sellers or Realtors possess the legal capacity to represent a property.

  • Escrow Coordination: Facilitating the secure routing of token advances and final considerations through designated banking partners.

  • Routine Compliance: Discharging overarching reporting and operational obligations required by prevailing law.

6.1. Voluntary Aadhaar Submission & Masking

The submission of Aadhaar details for KYC purposes is strictly voluntary. You may opt to provide alternative government-issued identification. If You voluntarily choose to upload an Aadhaar card, the Company shall redact/mask details in compliance with Unique Identification Authority of India (UIDAI) guidelines prior to storage.

6.2. Realtors' Representation of Consent

Where a Realtor, broker, or Mandate Holder uploads property details, NOCs, or title documents belonging to a third-party client (the actual property owner) onto the Platform, the Realtor explicitly warrants that they have obtained the express, verifiable, and lawful consent of the property owner to share such data with the Company. The Company assumes no liability for data uploaded by Realtors without their client’s explicit consent.

6.3. Incidental Third-Party Data (Chain of Title)

Primary title documents and NOCs uploaded to the Platform inherently contain the personal data of third parties (e.g., past owners, deceased relatives, or nominees in the chain of title). The Company processes this incidental data strictly for the legitimate purpose of verifying current ownership and legal authorization to transact.

  1. Disclosure

The Company strictly prohibits the sale, rental, or unauthorized commercial exploitation of Your data. Disclosure is strictly limited to:

  • Counterparties (Post-NDA): Core property dossiers, development data, and identity data are disclosed to verified buyers only subsequent to the execution of a binding digital NDA.

  • Banking and Escrow Partners: Financial data is shared strictly with scheduled commercial banks or regulated escrow agents to facilitate transaction milestones.

  • Empanelled & Referred Service Providers (Liability Disclaimer): The Platform relies on and may refer Users to both internal empanelled professionals and external independent contractors (e.g., legal counsel, architects, valuation experts) to facilitate transactions. While the Company facilitates these connections, these professionals operate in an independent capacity. The Company expressly disclaims any and all liability for their actions, omissions, negligence, or the accuracy of their independent deliverables and advice.

  • Statutory Authorities: We shall disclose data where mandated by judicial order, law enforcement agencies, or statutory bodies.

  1. Cookies And Tracking

The Platform utilizes cookies, web beacons, and tracking pixels to maintain session security, authenticate Users, and track access logs for security audit purposes. By using the Platform, you consent to the use of these essential tracking technologies. You may modify Your browser settings to decline non-essential cookies; however, doing so may restrict Your ability to utilize secure transaction features on the Platform.

  1. Data Security

9.1. Security Practices: We implement commercially reasonable, industry-standard security practices to protect Your data against unauthorized access, alteration, or destruction. These include role-based access controls, database encryption, and periodic internal security checks. 

9.2. Breach Notification: In the event of a material personal data breach that compromises Your privacy, the Company shall undertake reasonable efforts to notify the affected Data Principals (Users) and the relevant regulatory authorities in accordance with applicable statutory protocols.

Subject to statutory limitations, You possess the following rights:

  • Right to Access: To seek confirmation on whether Your data is being processed and obtain a summary thereof.

  • Right to Correction and Erasure: To request the rectification of inaccurate data or the deletion of data, provided such deletion does not contravene Our statutory retention obligations.

  • Right to Withdraw Consent: To withdraw consent for further processing, with the understanding that such withdrawal may render Us unable to fulfill ongoing transaction or escrow services.

  • Right of Grievance Redressal: To register complaints regarding data processing with Our Grievance Officer.

  1. Data Retention

Data shall be retained only for such period as is necessary to satisfy the commercial purposes outlined in this Policy, facilitate post-transaction support, or as strictly mandated by prevailing corporate, taxation, and real estate laws.

  1. Protection Of Minors

The Platform is strictly intended for use by individuals who have attained the age of majority (18 years and above) and possess the legal capacity to enter into binding real estate contracts. The Company does not knowingly collect, process, or track personal data from minors.

  1. Dispute Resolution

This Policy shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with the interpretation or implementation of this Privacy Policy shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall exclusively be Pune, Maharashtra, India.

  1. Modification Of Policy

The Company reserves the right to amend this Policy to reflect technological advancements, operational expansions, or statutory amendments. Continued use of the Platform subsequent to such modifications constitutes binding acceptance of the revised Policy.
